These Terms of Service ("Terms") govern your access to and use of the DeepJournal
mobile application and related services (collectively, the "Service") operated
by DeepJournal ("we", "us", or "our").
By creating an account or using the Service, you agree to these Terms. If you do
not agree, do not use the Service.
1. The Service
DeepJournal is a journaling and self-reflection tool. It uses artificial
intelligence to help you record thoughts, recall past entries, and receive
action suggestions.
DeepJournal is not a medical device. It does not provide medical advice,
diagnosis, treatment, or therapy. AI-generated responses may be inaccurate or
incomplete. They are not a substitute for professional mental health care,
counseling, or emergency services.
If you are in crisis, contact emergency services (911 in the US), call or text
988 (Suicide & Crisis Lifeline), or text HOME to 741741 (Crisis Text Line).
2. Eligibility
You must be at least 13 years old (or the minimum age required in your
jurisdiction) to use the Service. By using the Service, you represent that you
meet this requirement.
3. Account and Security
You are responsible for maintaining the confidentiality of your account
credentials and for all activity under your account. Notify us immediately at
support@deepjournal.app if you suspect unauthorized access.
4. Subscriptions and Payments
Some features require a paid subscription ("DeepJournal Pro").
- Subscriptions are billed through Apple's App Store and managed by Apple.
- Subscriptions auto-renew unless cancelled at least 24 hours before the end
of the current billing period.
- You can manage or cancel subscriptions in your Apple ID Account Settings.
- Refunds are handled by Apple according to Apple's policies; we do not process
refunds directly.
- Prices may change with notice as permitted by Apple and applicable law.
Free-tier limits (such as daily session limits and memory window) are described
in the app and may change with notice.
5. Acceptable Use
You agree not to:
- Use the Service for unlawful purposes or to harm others.
- Attempt to reverse engineer, scrape, or overload our systems.
- Submit content that violates others' rights or applicable law.
- Misuse crisis-support features or impersonate others.
- Use the Service to provide medical or therapeutic services to third parties.
We may suspend or terminate accounts that violate these Terms.
6. Your Content
You retain ownership of journal content you submit. You grant us a limited
license to process your content solely to operate the Service (for example,
generating AI responses, storing memories, and producing reports).
We do not use your journal content to train AI models. See our
Privacy Policy for details.
7. AI Disclaimer
AI features are provided "as is." We do not guarantee accuracy, completeness,
or suitability of AI outputs. You are solely responsible for decisions you make
based on AI suggestions.
8. Privacy
Our Privacy Policy explains how we collect, use, and
protect your information. It is incorporated into these Terms by reference.
9. Intellectual Property
The Service, including software, design, and branding, is owned by DeepJournal
or its licensors. These Terms do not grant you any rights to our intellectual
property except the limited right to use the Service as intended.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND,
WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEEPJOURNAL SHALL NOT BE LIABLE FOR ANY
INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS
OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE
TWELVE (12) MONTHS BEFORE THE CLAIM, OR USD $50, WHICHEVER IS GREATER.
12. Termination
You may delete your account at any time in Settings. We may suspend or terminate
access if you violate these Terms or if required by law. Upon termination, your
right to use the Service ends, subject to our data retention and deletion
practices in the Privacy Policy.
13. Changes
We may update these Terms. Material changes will be communicated in the app or
by email. Continued use after the effective date constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, United States,
without regard to conflict-of-law principles.
